Terms of Service
1. Who can use Mowdash
You must be at least 18 years old and able to enter into a binding contract. If you are using Mowdash on behalf of a business or organization, you represent that you have authority to bind that entity.
2. Your account
You sign in using your email and a one-time code. You are responsible for keeping access to your email account secure. You are responsible for all activity that occurs under your account.
3. What Mowdash is (and isn’t)
Mowdash is a technology platform that connects homeowners and organizations with independent landscapers. We are not a landscaping company. We do not employ landscapers; they operate as independent contractors. We do not own or control the equipment used to perform the service.
You agree that Mowdash is a marketplace, and that the actual lawn care service is provided by the landscaper you are matched with, not by Mowdash.
3a. Scope of work; no off-platform payment
The scope of each job is fixed at the moment the homeowner confirms the booking. The price you see and agree to covers only the lawn size and add-on services you selected, performed at the address you provided and consistent with the property notes on file at booking time. A landscaper is not authorized to perform additional work, mow areas outside the boundaries you described, or charge for anything you did not book.
- If you (the homeowner) would like additional work, you must agree to it in writing through the in-app Mowdash chat BEFORE that work begins. The chat transcript is the record of any scope change. Verbal agreements are not binding for billing purposes.
- You (the homeowner) are not obligated to pay for any work performed outside the booked scope without your prior written approval through Mowdash chat. Mowdash will side with the homeowner in any dispute where a landscaper claims to have performed extra work without a documented chat-based approval.
- All payments for services booked through Mowdash must be processed through Mowdash. Landscapers are prohibited from requesting cash, Venmo, Cash App, Zelle, PayPal, Apple Pay, check, or any other off-platform payment for jobs that originated on Mowdash, whether for the booked scope or for any additional work.
- A request from a landscaper for off-platform payment is a violation of these Terms. Homeowners are encouraged to report such requests immediately via the in-app flag tool (or by emailing [email protected]). Substantiated violations result in immediate account suspension or permanent ban of the landscaper, in addition to any payouts being withheld pending review.
These provisions exist to protect both sides — homeowners from coercion, and honest landscapers from being undercut by ones who do not respect the platform.
3b. Address and property verification
Homeowners are responsible for entering the correct service address and for maintaining accurate property notes describing what is in scope and what is not. Landscapers are responsible for verifying, on-site, that they are at the correct address and have understood the homeowner's property notes before beginning any work. Mowdash requires landscapers to explicitly acknowledge both before the mower starts.
- A landscaper who fails to verify the address or the property notes and performs work at the wrong location, or work beyond the described scope, does so at their own risk. They are not entitled to payment for misdirected or out-of-scope work.
- A homeowner who provides an incorrect address or property notes that materially misrepresent the property may be charged the cancellation fee for any wasted landscaper trip, at Mowdash's discretion.
4. Pricing and payment
When you book a job, you will see the full price before confirming. The total includes:
- The base price for the lawn size you select.
- A service fee that supports the Mowdash platform.
- Any applicable sales tax, where required by law.
You authorize Mowdash to charge your payment method on file when you confirm a job. The charge is authorized when a landscaper accepts your job, and captured when the job is released for payment (see Section 6).
For organization (HOA / property manager) accounts, charges may be aggregated into a monthly invoice instead of per-job charges.
5. Cancellations
- Before a landscaper has accepted your job, you can cancel at no charge.
- Once a landscaper has accepted, cancelling triggers a small cancellation fee (currently $5). The fee is paid to the landscaper for their committed time.
- You cannot cancel once mowing has begun.
A landscaper may also cancel a job they have accepted. If they do, you are not charged.
6. Payment release and 24-hour satisfaction window
When a landscaper marks a job complete, Mowdash holds the payment in escrow with our payment processor for a 24-hour satisfaction window before releasing funds to the landscaper.
- During the window, you can review the work (including any before/after photos and GPS verification provided by the landscaper) and either release payment immediately or report a problem.
- If you release payment, funds are transferred to the landscaper immediately.
- If you report a problem, the payment is held while Mowdash mediates the dispute in good faith.
- If you take no action within 24 hours of the job being marked complete — no release, no dispute — the payment will be automatically released to the landscaper. By using Mowdash, you agree that this automatic release after the satisfaction window constitutes your acceptance of the work as satisfactorily performed.
Once payment has been released — whether manually by you, automatically after the satisfaction window, or following dispute resolution — refunds may not be available except in limited circumstances at Mowdash's sole discretion.
7. Landscaper terms
If you operate as a landscaper through Mowdash, you agree that:
- You are an independent contractor and not an employee, agent, partner, or joint-venturer of Mowdash.
- You set your own hours, accept jobs at your discretion, are not required to accept any minimum number of jobs, and remain free to work for other platforms or directly with customers.
- You are responsible for your own equipment, vehicle, fuel, insurance (including general liability and any workers' compensation required by your jurisdiction), professional licenses, and business registrations.
- You will perform jobs competently, on time, and in a safe manner using equipment you own or are otherwise authorized to operate.
- You will treat customer property and personal information with respect, and will follow all reasonable instructions from the customer regarding their property.
- Mowdash retains a platform fee (currently 20% of the base price) from each completed job. The remainder is your payout, transferred via Stripe Connect.
8. Tax status and reporting
Landscapers using Mowdash hold IRS Form 1099 contractor status. Specifically:
- Mowdash will furnish, or facilitate the furnishing of, any tax forms it is required by law to provide. Because payouts are processed through Stripe Connect, you will typically receive Form 1099-K directly from Stripe, Inc. once your gross payment volume crosses the IRS reporting threshold then in effect for the tax year. Mowdash may also issue Form 1099-NEC for any compensation paid to you outside of the standard payout flow.
- You are solely responsible for calculating, reporting, and timely paying all federal, state, and local income taxes, self-employment taxes, and any other taxes owed on your Mowdash earnings, in accordance with all applicable tax laws.
- Mowdash does not withhold income tax, Social Security, Medicare, unemployment insurance, or any other employment-related amounts from your payouts.
- You are responsible for maintaining your own records of income and expenses for tax purposes, and for consulting a qualified tax professional regarding your obligations.
Where Mowdash is required by marketplace facilitator laws to collect and remit sales tax from homeowners on your behalf, the sales tax amount is added to the homeowner's total and is not deducted from your payout.
9. Acceptable use
You agree NOT to:
- Use Mowdash for any unlawful purpose.
- Harass, threaten, or harm landscapers, customers, or Mowdash staff.
- Impersonate another person or misrepresent your identity.
- Attempt to bypass Mowdash to transact directly with landscapers you found through the platform.
- Reverse-engineer, scrape, or interfere with the service.
- Submit false ratings or fraudulent payment information.
10. Disclaimers
Mowdash is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that landscapers will always be available in your area. We do not guarantee the quality of any individual landscaper’s work, though we will mediate disputes in good faith.
11. Property damage and personal injury
Lawn care involves powered equipment and inherent risks. By using Mowdash, you acknowledge and agree that:
- Landscapers are independent contractors who own, operate, and maintain their own equipment. Mowdash does not provide, inspect, service, or maintain any equipment used to perform jobs booked through the platform.
- Mowdash is not responsible or liable for any damage to your home, lawn, landscaping, vehicles, fences, sprinkler systems, irrigation, low-voltage wiring, structures, pets, other personal property, or for any personal injury arising from or related to the operation of a lawn mower, trimmer, blower, edger, or other equipment used to perform a job booked through the platform.
- Any claim for property damage or personal injury must be pursued directly against the landscaper who performed the service. Mowdash may, at its sole discretion, assist in facilitating communication between you and the landscaper, but is not a party to any such claim and has no obligation to investigate, mediate, or provide compensation for damage or injury claims.
- You are responsible for clearly marking or removing any obstacles, hidden hazards, valuables, sprinkler heads, low-voltage cables, lawn ornaments, or other items on or near the work area before a job begins. The landscaper is not expected to identify or avoid hazards that are not reasonably visible.
Nothing in this section limits any rights you may have under applicable consumer-protection law that cannot be waived by contract.
12. Limitation of liability
To the maximum extent permitted by law, Mowdash and its officers, directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of (a) $100 USD or (b) the amounts you paid Mowdash in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold Mowdash harmless from any claim or demand arising out of your use of the service, your violation of these Terms, or your violation of any third-party right.
14. Termination
You can stop using Mowdash and delete your account at any time. We may suspend or terminate your account if you violate these Terms, abuse the service, or expose Mowdash or its users to risk. We will give you notice and a chance to cure unless circumstances make that impractical.
15. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Disputes will be resolved by binding individual arbitration in Nashville, TN under the rules of the American Arbitration Association, except that either party may bring a claim in small-claims court if eligible. You waive any right to participate in a class action.
16. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you in the app and by email at least 14 days before the change takes effect. Continued use after the effective date means you accept the new Terms.
